Dear Mr. Jonathan Hatwell,

On behalf of the many organizations and groups from 21 states and entities in the EU involved in our earlier letter, thank you for your constructive and substantive response.

Like you and the High Representative and High Representative for Foreign Affairs Josep Borrell, we believe that the PDCA is of fundamental importance for improving the EU’s bilateral relations with the Republic of Cuba, especially because of the great convergence of challenges and the possibility of setting in motion a win-win process for mutual benefit.

With this reply, we would like to support key aspects with the aim of a concrete and successful implementation of the EU objectives you mentioned.

 

US embargo/blockade in general

High Representative Borrell, as you rightly write, has on several occasions continued to express the EU’s view that the embargo and extraterritorial sanctions are morally wrong and politically counterproductive. The EU’s position is that the embargo affects the living conditions of Cubans and also undermines the necessary reform process and modernization efforts.

However, its efforts and talks with the US administration to date have obviously been unsuccessful! Yes: on the contrary, some elements of the Blockade laws and sanctions have been tightened. What have you done wrong or inadequately so far, and what do you intend to do differently based on this frustrating experience?

 

Titles III and IV of the Helms-Burton Act

You write that the EU strongly opposes the activation of Titles III and IV of the Helms-Burton Act by the US in April 2019, as this would violate the commitments made by the US in the 1997 and 1998 agreements between the US and the EU. You further state that you will take all appropriate measures to counter the effects of the Helms-Burton Act, including in relation to our WTO rights and through the application of the EU Blocking Statute, which protects against the extraterritorial application of these US sanctions to EU citizens, companies and NGOs operating in Cuba.

Here, too, there have been no positive and successful changes.

 

SST list (State Sponsors of Terrorism)

The EU statement on the UN vote also criticized the renewed classification of Cuba as a state sponsor of terrorism because no new, relevant facts had been presented. According to the EU, the arbitrary classification of Cuba in the SST list has led to obstacles for international financial transactions with the island state.

Current UN intervention: Last week, a working group of UN experts urged the United States to critically review its approach to the SST list. Their statements are clear:

„The unilateral designation itself violates the fundamental principles of international law, including the principle of sovereign equality of States, the prohibition of interference in the internal affairs of States and the principle of peaceful settlement of international disputes,“ the experts said. They recalled that these principles are generally recognized, peremptory norms of international law.

„Fundamental human rights, including the right to food, the right to health, the right to education, economic and social rights, the right to life and the right to development, are negatively affected by the additional restrictions and prohibitions triggered by the expulsion of SST,“ the experts said.

In addition, the process by which the designation is made is unclear and lacks transparency. Relevant US legislative acts exacerbate fear and uncertainty, creating or reinforcing over-compliance among humanitarian and other actors seeking to engage or operate in the territory of the designated country,“ the authors said.

„The designation mainly affects countries that are already subject to other unilateral coercive measures and has a potentially catastrophic impact on the humanitarian situation and human rights.“

This raises the question of what concrete steps the EU is prepared to take to remedy this injustice, this situation that violates international law and human rights, or to make an appropriate contribution to it?

The EU must intervene here in order to reduce and abolish the aforementioned „exacerbation of fear and insecurity“ caused by the unilateral sanctions policy of the USA – especially against the neighboring state of Cuba – from international coexistence. This US policy represents a variant of a Cold War and is also a violation of international law according to the UN Charter.

 

We recommend and call for the following measures to achieve the goals of the PCDA and to strengthen multilateralism and international law:

1. talks with the US administration to date have still not resulted in the US finally returning to compliance with the 1996-1998 agreements with the EU. The EU must therefore put forward more effective arguments and concrete demands – with deadlines – possibly with higher-ranking representatives of the US administration.
2. the EU should take up a few exemplary cases of penalty payment demands by the US authorities against banks or companies in the EU before a competent court in the USA (e.g. New York) and provide the banks and companies with appropriate legal support in the court proceedings. Here it is important to reject the demanded penalty payment and have it nullified in court (i.e. to clarify the question: may a US entity enforce legal requirements and thus violate the sovereignty of the respective penalized country, which is based on and guaranteed by international law).
3. we call on the EU to prepare a complaint with the WHO, as it did in 1996. In the case of Cuba, the violations of rights by the US embargo violate the human rights of 11 million Cuban citizens. In addition, human rights are being violated in numerous other countries and regions, particularly in the EU. These ruinous violations must no longer be tolerated!

(4) The EU should develop an alternative payment mechanism to allow financial transfers to countries under US sanctions, replacing the defunct Instrument in Support of Trade Exchanges (INSTEX).

5. when can we and European citizens and businesses expect to see the revised version of the Blocking Statute, which should include additional deterrence mechanisms and simplify its application? We have participated in the investigation and believe that it is time to implement the new statute.
6. banks and other financial institutions in the EU in particular often do not comply with European law, but with unilateral and extraterritorial US rules that violate international law and the UN principles of multilateralism and fair trade. This undermines the sovereignty of the EU system. Therefore, the EU and/or the EBA must take new specific actions and measures to make banks comply with the recommendations of the January 2022 de-risking report.
7. overall and in addition to the measures mentioned above, the EU needs to launch a public campaign (not least as a signal to partners in the US) to better inform companies, banks, organizations and citizens about the blocking minority and make possible support transparent. In addition, the costs for non-compliance with the blocking statute should be increased and be higher than the threatened penalties of the US authorities.

8) For all these measures, discussions and approaches, the clear judgment and its well-founded legal justification of the international tribunal should be explicitly used. This took place on November 16-17 in the premises of the European Parliament and was conducted by leading judges, lawyers and legal experts from various countries. Their unanimous verdict was:

„The comprehensive political and economic sanctions that have been imposed on the Republic of Cuba since 1960 violate international law.“

The individual legal principles are listed, such as the UN Charter, the Universal Declaration of Human Rights, the provisions of the World Trade Organization and numerous principles of the Treaty on European Union. It goes on to say:

„The dramatic and enormous impact of the laws and regulations that have been maintained for more than 60 years also show that no blockade has been as comprehensive, long-lasting and brutal against a people as the one maintained by the United States against Cuba. The blockade has led directly and indirectly to the loss of numerous lives, and the US decision to maintain this blockade until the Cuban people decide to submit shows that the US is determined to maintain measures aimed at bringing about the physical destruction of at least part of the Cuban people in the long term. Such an attitude could constitute the crime of genocide.“

The judges concluded:

„Since the numerous sanctions and the US laws on which they are based are unlawful, they must be lifted. The US must pay for the damage caused to the Cuban state, its companies and its citizens.“

Now that the US administration has ignored all previous bilateral reminders from the EU and other countries, as well as the clear, emphatic demands of the global community, tangible, more effective measures must be taken and better steps must be taken. All of us, and especially the many young members of our participating organizations, cannot and will not tolerate living and working in an EU where the law of a foreign power prevails, and not the law and principles of our own democratically elected system.

We already consider it shameful how long the US blockade with its many destructive effects has been allowed to maltreat the people in Cuba and also in Europe. We are losing patience!

The EU must act urgently and with noticeable force and effect.

En nombre de las numerosas organizaciones y grupos de 21 estados y entidades de la UE implicados en nuestra carta anterior, gracias por su respuesta constructiva y sustantiva.

Al igual que usted y que el Alto Representante y Comisario de Asuntos Exteriores, Josep Borrell, creemos que el PDCA es de fundamental importancia para mejorar las relaciones bilaterales de la UE con la República de Cuba, especialmente por la gran convergencia de retos y la posibilidad de poner en marcha un proceso beneficioso para ambas partes.

Con esta respuesta, nos gustaría apoyar aspectos clave con vistas a una realización concreta y exitosa de los objetivos de la UE que usted ha mencionado.

 

Embargo/bloqueo estadounidense en general

El Alto Representante Borrell, como bien escribe usted, ha mantenido en varias ocasiones la opinión de la UE de que el embargo y las sanciones extraterritoriales son moralmente erróneos y políticamente contraproducentes. La posición de la UE es que el embargo afecta a las condiciones de vida de los cubanos y también socava el necesario proceso de reforma y los esfuerzos de modernización.

Sin embargo, sus esfuerzos y conversaciones con la administración estadounidense hasta la fecha han sido obviamente infructuosos. Sí: al contrario, algunos elementos de las leyes y sanciones de Blockade se han endurecido aún más. ¿Qué han hecho mal o inadecuadamente hasta ahora, y qué piensan hacer de forma diferente como resultado de esta frustrante experiencia?

 

Títulos III y IV de la Ley Helms-Burton

Usted escribe que la UE se opone firmemente a la activación de los Títulos III y IV de la Ley Helms-Burton por parte de EE.UU. en abril de 2019, ya que esto violaría los compromisos asumidos por EE.UU. en los acuerdos de 1997 y 1998 entre EE.UU. y la UE. Además, declara que tomará todas las medidas apropiadas para contrarrestar los efectos de la Ley Helms-Burton, incluso en relación con nuestros derechos en la OMC y mediante la aplicación del Estatuto de Bloqueo de la UE, que protege contra la aplicación extraterritorial de estas sanciones estadounidenses a ciudadanos, empresas y ONG de la UE que operan en Cuba.

Tampoco aquí se han producido cambios positivos y satisfactorios.

 

Lista SST (Estados patrocinadores del terrorismo)

La declaración de la UE sobre la votación de la ONU también criticó la reclasificación de Cuba como Estado patrocinador del terrorismo porque no se habían presentado hechos nuevos y relevantes. Según la UE, la categorización arbitraria de Cuba en la lista SST ha supuesto obstáculos para las transacciones financieras internacionales con el Estado insular.

Intervención actual de la ONU: La semana pasada, un grupo de trabajo de expertos de la ONU instó a Estados Unidos a revisar críticamente su enfoque de la lista de TSM. Sus declaraciones son claras:

„La propia designación unilateral viola los principios fundamentales del derecho internacional, incluido el principio de igualdad soberana de los Estados, la prohibición de injerencia en los asuntos internos de los Estados y el principio de solución pacífica de las controversias internacionales“, afirmaron los expertos. Recordaron que estos principios son normas imperativas de derecho internacional generalmente reconocidas.

„Los derechos humanos fundamentales, incluidos el derecho a la alimentación, el derecho a la salud, el derecho a la educación, los derechos económicos y sociales, el derecho a la vida y el derecho al desarrollo, se ven afectados negativamente por las restricciones y prohibiciones adicionales desencadenadas por la expulsión del TSM“, afirmaron los expertos.

Además, el proceso por el que se realiza la designación no está claro y carece de transparencia. Los actos legislativos pertinentes de EE.UU. exacerban el miedo y la incertidumbre, creando o reforzando el exceso de cumplimiento entre los actores humanitarios y de otro tipo que pretenden comprometerse u operar en el territorio del país designado“, señalaron los autores. „La designación afecta principalmente a países que ya son objeto de otras medidas coercitivas unilaterales y tiene un impacto potencialmente catastrófico en la situación humanitaria y los derechos humanos“.

Esto plantea la cuestión de qué medidas concretas está dispuesta a tomar la UE para remediar esta injusticia, esta situación que viola el derecho internacional y los derechos humanos, o para contribuir adecuadamente a ella.

La UE debe intervenir aquí para reducir y abolir la mencionada „exacerbación del miedo y la inseguridad“ provocada por la política de sanciones unilaterales de EE.UU. -especialmente contra el Estado vecino de Cuba- de la convivencia internacional. Esta política de EE.UU. representa una variante de la Guerra Fría y es también una violación del derecho internacional según la Carta de la ONU.

 

Recomendamos y exigimos las siguientes medidas para alcanzar los objetivos del PCDA y fortalecer el multilateralismo y el derecho internacional:

1. las conversaciones con la administración estadounidense hasta ahora todavía no han conseguido que EE.UU. vuelva a cumplir finalmente los acuerdos de 1996-1998 con la UE. Por lo tanto, la UE debe presentar argumentos más eficaces y exigencias concretas -con plazos- posiblemente ante representantes de mayor rango de la administración estadounidense.
2. la UE debería llevar ante un tribunal competente de EE.UU. (por ejemplo, Nueva York) algunos casos ejemplares de exigencias de multas coercitivas por parte de las autoridades de EE.UU. contra bancos o empresas de la UE y proporcionar a los bancos y empresas el apoyo jurídico adecuado en el procedimiento judicial. En este sentido, es importante rechazar la multa exigida y hacer que se anule en los tribunales (es decir, aclarar la pregunta: ¿puede una entidad estadounidense hacer cumplir requisitos legales y violar así la soberanía del respectivo país sancionado, que está basada y garantizada por el Derecho internacional).

3) Pedimos a la UE que prepare una queja ante la OMS, como ya hizo en 1996. En el caso de Cuba, las violaciones de derechos por parte del embargo de EE.UU. violan los derechos humanos de 11 millones de ciudadanos cubanos. Además, se violan los derechos humanos en muchos otros países y regiones, especialmente en la UE. ¡Estas ruinosas violaciones no deben seguir tolerándose!

4) La UE debe desarrollar un mecanismo de pago alternativo que permita las transferencias financieras a los países sometidos a sanciones estadounidenses, sustituyendo al cancelado Instrumento de Apoyo a los Intercambios Comerciales (INSTEX).

5) ¿Cuándo podemos esperar, tanto nosotros como los ciudadanos y las empresas europeas, ver la versión revisada del Estatuto de Bloqueo, que debería incluir mecanismos disuasorios adicionales y simplificar su aplicación?

Hemos participado en la investigación y creemos que ha llegado el momento de aplicar el nuevo estatuto.

6) En particular, los bancos y otras instituciones financieras de la UE a menudo no cumplen la legislación europea, sino normas unilaterales y extraterritoriales de EE.UU. que violan el derecho internacional y los principios de multilateralismo y comercio justo de la ONU. Esto socava la soberanía del sistema de la UE. Por lo tanto, la UE y/o la ABE deben adoptar nuevas acciones y medidas específicas para hacer que los bancos cumplan las recomendaciones del informe de enero de 2022 sobre la reducción de riesgos.

7. En general, y además de las medidas mencionadas anteriormente, la UE debe lanzar una campaña pública (sobre todo como señal a los socios de EE.UU.) para informar mejor a las empresas, bancos, organizaciones y ciudadanos sobre la minoría de bloqueo y hacer transparentes las posibles ayudas. Además, los costes por incumplimiento del estatuto de bloqueo deberían incrementarse y ser superiores a las sanciones con las que amenazan las autoridades estadounidenses.

8) Para todas estas medidas, debates y planteamientos, debería utilizarse explícitamente la clara sentencia y su fundamentada justificación jurídica del tribunal internacional. Esta tuvo lugar los días 16 y 17 de noviembre en los locales del Parlamento Europeo y corrió a cargo de destacados jueces, abogados y juristas de varios países. Su juicio unánime fue:

„Las amplias sanciones políticas y económicas impuestas a la República de Cuba desde 1960 violan el derecho internacional“.

Se enumeran los distintos principios jurídicos, como la Carta de las Naciones Unidas, la Declaración Universal de Derechos Humanos, las disposiciones de la Organización Mundial del Comercio y numerosos principios del Tratado de la Unión Europea. Continúa diciendo

„El dramático y enorme impacto de las leyes y regulaciones que se han mantenido durante más de 60 años demuestran también que ningún bloqueo ha sido tan amplio, duradero y brutal contra un pueblo como el mantenido por Estados Unidos contra Cuba. El bloqueo ha provocado directa e indirectamente la pérdida de muchas vidas, y la decisión de EE.UU. de mantener este bloqueo hasta que el pueblo cubano decida someterse demuestra que EE.UU. está decidido a mantener medidas encaminadas a provocar la destrucción física de al menos parte del pueblo cubano a largo plazo. Tal actitud podría constituir un delito de genocidio“.

Los jueces concluyeron:

„Dado que las numerosas sanciones y las leyes estadounidenses en las que se basan son ilegales, deben ser levantadas. Estados Unidos debe pagar por los daños causados al Estado cubano, a sus empresas y a sus ciudadanos“.

Ahora que la administración estadounidense ha hecho caso omiso de todos los recordatorios bilaterales anteriores de la UE y otros países, así como de las exigencias claras y rotundas de la comunidad mundial, deben tomarse medidas tangibles y más eficaces, y deben darse mejores pasos. Todos nosotros, y especialmente los numerosos miembros jóvenes de nuestras organizaciones participantes, no podemos tolerar ni toleraremos vivir y trabajar en una UE en la que prevalezca la ley de una potencia extranjera, en lugar de la ley y los principios de nuestro propio sistema democráticamente elegido.

Ya consideramos vergonzoso el tiempo que se ha permitido que el bloqueo estadounidense, con sus numerosos efectos destructivos, maltrate a la población en Cuba y también en Europa. Estamos perdiendo la paciencia.

La UE debe actuar urgentemente y con notable vigor y efecto.

Sehr geehrter Herr Jonathan Hatwell,

ich danke Ihnen auch im Namen der an unserem früheren Schreiben beteiligten zahlreichen Organisationen und Gruppen aus 21 Staaten und Entitäten in der EU für Ihr konstruktives und substanzielles Antwortschreiben.

Wir sind wie Sie und der Hohe Vertreter und Außenbeauftragte Josep Borrell der Auffassung, dass das PDCA von grundlegender Bedeutung für eine Verbesserung der bilateralen Beziehungen der EU mit der Republik Kuba ist, zumal wegen der großen Übereinstimmungen bei den Herausforderungen, und der Möglichkeit, einen win-win-Prozess zu beiderseitigem Nutzen in Gang zu setzen.

Mit diesem Antwortschreiben möchten wir zentrale Aspekte mit dem Ziel einer konkreten und erfolgreichen Umsetzung der von Ihnen erwähnten EU-Ziele unterstützen.

 

US-Embargo/Blockade allgemein

Der Hohe Vertreter Borrell hat, wie Sie zutreffend schreiben, bei mehreren Gelegenheiten nach wie vor die Auffassung der EU vertreten, dass das Embargo und die extraterritorialen Sanktionen moralisch falsch und politisch kontraproduktiv sind. Die EU vertritt den Standpunkt, dass das Embargo die Lebensbedingungen der Kubanerinnen und Kubaner beeinträchtigt und auch den notwendigen Reformprozess und die Modernisierungsbemühungen untergräbt.

Ihre bisherigen Bemühungen und Gespräche mit der US-Administration waren jedoch offensichtlich erfolglos!  Ja: im Gegenteil wurden einige Elemente der Bockadegesetze und Sanktionsmaßnahmen noch verschärft. Was haben Sie bisher falsch oder unzureichend getan, und was gedenken Sie aufgrund der frustrierenden Erfahrung anders zu tun?

 

Titel III und IV des Helms-Burton-Gesetzes

Sie schreiben, dass die EU die Aktivierung der Titel III und IV des Helms-Burton-Gesetzes durch die USA im April 2019 entschieden ablehne, da dies gegen die von den USA in den Abkommen zwischen den USA und der EU von 1997 und 1998 eingegangenen Verpflichtungen verstoße. Dazu führen Sie weiter aus, dass Sie alle geeigneten Maßnahmen ergreifen werden, um gegen die Auswirkungen des Helms-Burton-Gesetzes vorzugehen, auch in Bezug auf unsere WTO-Rechte und durch die Anwendung des EU-Sperrstatuts, das vor der extraterritorialen Anwendung dieser US-Sanktionen auf in Kuba tätige EU-Bürger, Unternehmen und NROs schützt.

Auch hier zeigen sich keine positiven und erfolgreichen Veränderungen.

 

SST-Liste (State Sponsors of Terrorism)

In der Erklärung der EU zur UN-Abstimmung wurde auch die erneute Einstufung Kubas als Staat, der den Terrorismus fördert, moniert, weil keine neuen, relevanten Fakten vorgelegt worden sind. Die willkürliche Einordnung Kubas in die SST-Liste hat nach Auffassung der EU zu Hindernissen für internationale Finanztransaktionen mit dem Inselstaat geführt.

Aktuelle UN-Intervention: Eine Arbeitsgruppe von UN-Expert*innen hat in der vergangenen Woche die Vereinigten Staaten dringend aufgefordert, ihre Verfahrensweise zur SST-Liste kritisch zu überprüfen. Ihre Aussagen sind klar:

„Die einseitige Benennung selbst verstößt gegen die grundlegenden Prinzipien des Völkerrechts, einschließlich des Grundsatzes der souveränen Gleichheit der Staaten, des Verbots der Einmischung in die inneren Angelegenheiten von Staaten und des Grundsatzes der friedlichen Beilegung internationaler Streitigkeiten“, so die Experten. Sie erinnerten daran, dass diese Grundsätze allgemein anerkannte, zwingende Normen des Völkerrechts darstellen.

„Grundlegende Menschenrechte, einschließlich des Rechts auf Nahrung, des Rechts auf Gesundheit, des Rechts auf Bildung, der wirtschaftlichen und sozialen Rechte, des Rechts auf Leben und des Rechts auf Entwicklung, werden durch die zusätzlichen Einschränkungen und Verbote, die durch die Ausweisung von SST ausgelöst werden, negativ beeinflusst“, so die Experten.

Darüber hinaus ist der Prozess, durch den die Benennung erfolgt, unklar und intransparent. Einschlägige US-Gesetzgebungsakte verschärfen Angst und Unsicherheit, schaffen oder verstärken eine übermäßige Konformität bei humanitären und anderen Akteuren, die sich im Hoheitsgebiet des bezeichneten Landes engagieren oder dort tätig werden wollen“, so die Autoren. „Die Benennung betrifft vor allem Länder, die bereits anderen einseitigen Zwangsmaßnahmen ausgesetzt sind, und hat möglicherweise katastrophale Auswirkungen auf die humanitäre Lage und die Menschenrechte.“

Hier stellt sich die Frage, welche konkreten Schritte die EU zu tun bereit ist, um diese Ungerechtigkeit, diese völkerrechtwidrige und menschenrechtsverletzende Situation zu beheben bzw. einen angemessenen Beitrag dazu zu leisten?

Hier muss die EU eingreifen, um die erwähnte “Verschärfung von Angst und Unsicherheit“ durch die unilaterale Sanktionspolitik der USA – gerade auch gegen den Nachbarstaat Kuba, aus dem internationalen Miteinander zu reduzieren und abzuschaffen. Diese US-Politik stellt eine Variante eines Kalten Krieges dar, und ist auch gemäß UN-Charta völkerrechtsverletzend.

 

Wir empfehlen und fordern folgende Maßnahmen, um die Ziele des PCDA zu erreichen und Multilateralismus sowie Völkerrecht zu stärken:

1. Die bisherigen Gespräche mit der US-Administration haben immer noch nicht dazu geführt, dass die USA endlich wieder die Vereinbarungen mit der EU aus den Jahren 1996-1998 einhält. Daher müssen von der EU effektivere Argumentationen und konkrete Forderungen – mit Terminsetzungen – vorgetragen werden, womöglich mit höherrangigen Repräsentanten der US-Regierung.
2. Die EU sollte einige wenige exemplarische Fälle von Strafzahlungsforderungen der US-Behörden gegen Banken oder Unternehmen in der EU vor einem zuständigen Gericht in den USA (z.B. New York) aufgreifen, und die Banken und Unternehmen juristisch bei den Gerichtsverfahren angemessen unterstützen. Hier gilt es, die geforderten Strafzahlung abzulehnen und gerichtlich nullifizieren zu lassen (also Frage klären lassen: darf eine US-Entität rechtliche Vorgaben, und damit eine Verletzung der völkerrechtlich fundierten und garantierten Souveränität des jeweiligen bestraften Landes, durchsetzen?).
3. Wir fordern die EU auf, to prepare a complaint with the WHO, as it did in 1996. Die Rechtsverletzungen durch das US-Embargo verletzen im Falle Kubas die Menschenrechte von 11Mio. kubanischen Bürgerinnen und Bürgern. Hinzu kommt die Verletzung von Menschenrechten in zahlreichen anderen Ländern und Regionen, insbesondere auch der EU. Diese ruinösen Verletzungen dürfen nicht länger toleriert werden!
4. Die EU sollte einen alternativen Zahlungsmechanismus entwickeln, der Finanztransfers in Länder ermöglicht, die unter US-Sanktionen fallen, und der das aufgelöste Instrument zur Unterstützung des Handelsaustauschs (INSTEX) ersetzt.
5. Wann können wir und die europäischen Bürger und Unternehmen mit der überarbeiteten Fassung des Blocking Statute rechnen, die zusätzliche Abschreckungsmechanismen enthalten und ihre Anwendung vereinfachen sollte? Wir haben an der Untersuchung teilgenommen und sind der Meinung, dass es an der Zeit ist, das neue Statut umzusetzen.
6. Insbesondere Banken und andere Finanzinstitute in der EU halten sich oft nicht an europäisches Recht, sondern an einseitige und extraterritoriale US-Vorschriften, die gegen das Völkerrecht und die UN-Grundsätze des Multilateralismus und des fairen Handels verstoßen. Dadurch wird die Souveränität des EU-Systems ausgehöhlt. Daher müssen die EU und/oder die EBA neue spezifische Aktionen und Maßnahmen ergreifen, um die Banken dazu zu bringen, die Empfehlungen des De-Risking-Berichts vom Januar 2022 zu befolgen.
7. Insgesamt und ergänzend zu den oben genannten Maßnahmen muss die EU eine öffentliche Kampagne starten (nicht zuletzt als Signal an die Partner in den USA), um Unternehmen, Banken, Organisationen und Bürger besser über die Sperrminorität zu informieren und mögliche Unterstützung transparent zu machen. Darüber hinaus sollten die Kosten für die Nichteinhaltung des Blocking Statute erhöht werden und höher sein als die angedrohten Strafen der US-Behörden.
8. Für all diese Maßnahmen, Gespräche und Vorgehensweisen sollte das klare Urteil und dessen fundierte juristische Begründung des internationalen Tribunals explizit genutzt werden. Dieses fand am16.-17.November in den Räumen des Europäischen Parlaments statt und wurde von führenden Richtern, Anwälten und Rechtsfachleuten aus verschiedenen Staaten durchgeführt. Ihr einhelliges Urteil lautet:

„Die umfassenden politischen und wirtschaftlichen Sanktionen, die seit 1960 gegen die Republik Kuba verhängt wurden verstoßen gegen das Völkerrecht.“

Dazu werden die einzelnen Rechtsgrundsätze aufgezählt, wie die UN-Charta, die Allgemeine Erklärung der Menschenrechte, die Bestimmungen der Welthandelsorganisation sowie zahlreiche Grundsätze des Vertrags über die Europäische Union. Weiter heißt es:

„Die dramatischen und enormen Auswirkungen der Gesetze und Verordnungen, die seit mehr als 60 Jahren aufrechterhalten werden, zeigen auch, dass keine Blockade so umfassend, lang anhaltend und brutal gegen ein Volk war wie diejenige, die die USA gegen Kuba aufrechterhalten. Die Blockade hat direkt und indirekt zum Verlust zahlreicher Menschenleben geführt, und die Entscheidung der USA, diese Blockade aufrechtzuerhalten, solange das kubanische Volk nicht beschließt, sich zu beugen, zeigt, dass die USA entschlossen sind, Maßnahmen aufrechtzuerhalten, die darauf abzielen, langfristig die physische Zerstörung zumindest eines Teils des kubanischen Volkes zu bewirken. Eine solche Haltung könnte den Tatbestand des Völkermordes erfüllen.“

Die Schlussfolgerung der Richter lautet:

„Da die zahlreichen Sanktionen und die US-Gesetze, auf denen sie beruhen, rechtswidrig sind, müssen sie aufgehoben werden. Die USA müssen für den Schaden aufkommen, der dem kubanischen Staat, seinen Unternehmen und Bürgern entstanden ist.“

Nachdem die US-Administration sämtliche bisherigen bilateralen Mahnungen der EU und anderer Länder sowie die eindeutigen, nachdrücklichen Forderungen der Weltgemeinschaft ignoriert hat, müssen spürbare, effektivere Maßnahmen ergriffen und bessere Schritte gegangen werden. Wir alle, und insbesondere die vielen jungen Mitglieder unserer beteiligten Organisationen können und wollen nicht tolerieren, in einer EU zu leben und zu arbeiten, in dem das Recht einer ausländischen Macht vorherrscht, und nicht das Recht und die Prinzipien des demokratisch gewählten eigenen Systems.

Schon jetzt halten wir es für beschämend, wie lange bereits die US-Blockade mit ihren vielfältigen destruktiven Effekten die Menschen in Kuba und auch in Europa malträtieren darf. Wir verlieren die Geduld!

Hier muss die EU dringend und mit spürbarem Nachdruck und Effekt handeln.
